HBS does not publish fixed pricing on the Website. All pricing is provided through individualized, custom quotes following a consultation and is subject to the terms of a separate signed engagement agreement, as described in Section 4 below.

4. No Client Relationship Formed Through Website Use
Browsing the Website, submitting a contact form, requesting information, or scheduling a free consultation through the Website does NOT create a client relationship, an engagement, or any contractual obligation between you and HBS. No confidential, privileged, or fiduciary relationship of any kind is formed through use of the Website.
A client relationship with HBS begins only when both you and HBS have executed a separate, signed engagement letter or Statement of Work that sets out the specific services to be performed, fees, timelines, and other applicable terms. Until such an agreement is signed by both parties, HBS has no obligation to provide any services to you, and any information you share through the Website’s contact form or scheduling tool should not be treated as confidential or protected by any professional-client privilege.
You should not send sensitive financial, tax, banking, or personally identifiable information through the Website’s contact form or scheduling tool. HBS is not responsible for the security of information transmitted before a signed engagement is in place and before secure, client-specific systems have been established.
5. Intellectual Property

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HBS AND ITS OWNERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE WEBSITE, EVEN IF HBS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HBS’S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100). This limitation applies solely to use of the Website itself; it does not apply to, limit, or modify any liability provisions in a separate, signed client engagement letter or Statement of Work, which is a distinct agreement governed by its own terms.

You agree to defend, indemnify, and hold harmless Hastings Business Solutions, LLC and its owners, members, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with: (a) your access to or use of the Website; (b) your violation of these Terms; or (c) your violation of any applicable law or the rights of any third party.
11. Governing Law and Venue
These Terms and any dispute arising out of or related to your use of the Website shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict-of-law principles.
You agree that any legal action or proceeding arising out of or related to these Terms or the Website shall be brought exclusively in the state or federal courts located in Arapahoe County, Colorado, and you consent to the personal jurisdiction and venue of such courts.

HBS may revise or update these Terms from time to time at its sole discretion. When we do, we will update the “Effective Date” at the top of this page. Your continued use of the Website following the posting of any changes constitutes acceptance of those changes. We encourage you to review these Terms periodically.
